Terms of Service — castleX designer

These terms are a contract between you (or the business you act for, "you") and CASTLE X LTD (company no. 17205101, registered in England and Wales) ("we") for the use of the castleX designer web application (the "Service"). By creating an account or signing in you accept them. If you do not agree, do not use the Service.

1. What the Service is

castleX designer is online software for planning retail store layouts, producing 3D views, simulations, films and quotations. It is provided as a service that you access through a browser; no copy of the software is sold or delivered to you.

2. Accounts and the free trial

1. An account belongs to one named person at one e-mail address. You must keep your sign-in codes to yourself and must not share an account. A new sign-in ends any other session on the same account.
2. Each new account gets a free trial of 14 days from its first sign-in, with every feature unlocked and no payment details required. The trial ends automatically — nothing is charged and no subscription starts unless you choose to subscribe. One trial per person or business; trials may not be repeated with other e-mail addresses.
3. We may refuse, suspend or close an account that breaks these terms, is used for fraud, or has not paid.

3. Subscription, payment and cancellation

1. The Service is licensed per named user at £49 / month, or £490 / year paid annually (or another price shown at checkout), billed in advance through our payment provider, Stripe, in pounds sterling. Prices exclude VAT; VAT is added at checkout where it applies and is shown before you pay.
2. Your subscription renews automatically at the end of each paid period (monthly or yearly) at the price shown at checkout, until you cancel. You can cancel at any time, online, from the Plan page ("Manage billing"); access then continues until the end of the period already paid for and nothing further is charged. Before each yearly renewal we e-mail you a reminder.
3. Money-back guarantee: if the Service is not right for you, tell us at info@castlex.uk within 14 days of your first payment and we refund it in full to the card used. Renewal payments are not refunded, except where the law requires it. Nothing in these terms affects your statutory rights, including a consumer's 14-day right to cancel under the Consumer Contracts Regulations 2013.
4. If a renewal payment fails we may keep access open for a short grace period and then suspend the account until payment is made.
5. We may change prices with at least 30 days' notice by e-mail; the new price applies from your next renewal after the notice.

4. Licence and restrictions

1. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own business through the account we provide, for as long as your subscription or trial is valid.
2. You must not: copy, download, decompile, reverse-engineer, extract or attempt to obtain the source code of the Service or any part of it; remove or hide licence notices, watermarks or identifiers; frame or mirror the Service on another site; use automated tools to scrape or record it; rent, resell, sublicense or share your access; or use the Service to build a competing product.
3. The Service, its code, designs, 3D models, product libraries, documentation and trademarks (including "castleX") are our property or that of our licensors and are protected by copyright and other laws. All rights not expressly granted are reserved.
4. Each copy of the Service delivered to your browser is marked with your account identity. A copy found outside the Service that carries your identity will be treated as a breach by you.

5. Your content

Plans, projects, quotes and files you create remain yours. You grant us the right to store and process them only to provide the Service. You are responsible for having the rights to anything you upload (for example product images or drawings) and for the accuracy of quotes you send to your own customers. Prices shown in the Service for products are indicative and must be checked before you rely on them.

6. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. We may update, change or withdraw features. Support is provided by e-mail at info@castlex.uk on a reasonable-effort basis during UK business hours.

7. Liability

1. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.
2. Subject to that, we are not liable for any loss of profit, business, contracts, data or goodwill, or for any indirect or consequential loss; and our total liability under or in connection with the Service in any 12-month period is limited to the fees you paid us in that period.
3. The Service is a design and estimating aid. Measurements, clearances, loads, compliance with building, fire or accessibility regulations and final costs must be checked by a qualified person before any work is carried out.

8. Ending the agreement

You may stop using the Service at any time. We may end this agreement immediately on notice if you breach section 4, and otherwise on 30 days' notice. On ending, your licence stops; you may export your projects beforehand. Sections 4, 5, 7 and 10 survive.

9. Privacy

How we handle personal data (your e-mail, name, sign-in times, IP address and device) is described in our Privacy Policy, which forms part of these terms.

10. General

These terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction. If any part is found invalid the rest still applies. We may update these terms; material changes will be announced by e-mail or in the Service at least 14 days before they take effect, and continued use after that date means you accept them. Business customers: you confirm you are using the Service in the course of business and not as a consumer.
